Privacy Statement - Kinetic Group Services Pty Ltd ("Kinetic")

We are committed to respecting the privacy of your personal information. This privacy policy sets out our policy in respect of the handling and protection of personal information.

We are bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth) and other laws that protect the privacy of your personal information. Kinetic Group Services Pty Ltd trading as Kinetic and its related bodies corporate (together “Kinetic” or “we”) sometimes handles personal information relying on exemptions under these laws, for example in relation to employee records and related bodies corporate. Any permitted handling of personal information under any of these laws will take priority over this privacy policy to the extent of any inconsistency.

Personal information we collect and hold

A reference to “personal information” in this policy means information which identifies you as an individual or from which your identity can be reasonably ascertained.

In certain circumstances, Kinetic may collect personal information about you, for example when you contact us. The types of personal information we collect may include your name, address, email address, telephone number, date of birth and identification information. Kinetic also collects personal information about your interactions with us, including any contact we have with you by telephone, email or online. For security, training, and dispute resolution purposes, we may also monitor and record your communications with us (including telephone and email) and operate video and audio surveillance devices in our premises and other areas of operation.

Where you provide us with personal information about another person, you must have their consent for Kinetic to collect and handle their information in accordance with this privacy policy.

We generally collect your personal information directly from you but may also collect it from third parties, including your representatives and travel companions and our related bodies corporate.

Use and disclosure of personal information

We collect, use, and disclose personal information to provide, administer and improve our services, maintain, and update our records, verify your identity, correspond with you, protect our lawful interests and deal with your questions, requests, and concerns.

We will only attempt to verify your identity where reasonably necessary to provide a service, as required as part of an investigation, incident, or to meet lawful requirements. We may not be able to do these things without your personal information. For example, we may not be able to respond to your enquiries.

Kinetic may also collect, use, and disclose personal information that you provide to provide marketing communications and targeted advertising to you on an ongoing basis by telephone, SMS, email, online and other means, unless you opt out or we are subject to legal restrictions. In some cases, we will ask for your specific permission to do things like share your details with a particular company for their own marketing purposes. We may do this with the assistance of our marketing service providers.

We may also collect, use, and disclose your personal information in connection with:

  • Suspected fraud, misconduct, or unlawful activity, or incident
  • Lawful information requests from courts, government agencies and legal practitioners; and
  • Acquisitions or potential acquisitions of our business.

Kinetic may exchange your personal information with third parties including our related bodies corporate, service providers and client recipients that assist us with archival, auditing, accounting, customer contact, legal, business consulting, banking, payment and refund processing, delivery, data processing, data analysis, research, marketing, investigation, or IT services.

We hold personal information electronically and in hard copy form, both at our own premises and with the assistance of our service providers.

Our website and emails

When using our social media and website “wearekinetic.com” and any websites of our related bodies corporate and businesses, including those linked from the “wearekinetic.com” website (collectively “Sites") we may collect information about location or activity including your IP address.

In the operation of our Sites, we use technology that allows us to monitor traffic patterns and ascertain and record information such as how people use our Sites, how long they access various pages and which links they click, including links that bring them to our website. We use this information to improve our Sites content and ease of use.

‘Cookies’ are used by the Sites including “wearekinetic.com” to track a visitor’s navigation in the Sites. Cookies are not used to collect or record any personal information. A cookie is a piece of information that allows our system to identify and interact more effectively with your device. The cookie helps us to maintain the continuity of your browsing session. You can change the settings on your web browser software to reject cookies, but this may impact the functionality of some parts of our Sites.

If you are considering sending us any other personal information through our Sites or via other electronic means, please be aware that the information may be insecure in transit, particularly where no encryption is used (e.g., email, standard HTTP). Our Sites may contain links to other websites which are not controlled or maintained by us. Those links are provided for convenience only. We are not responsible for the content or privacy practices associated with linked websites.

Recruitment


When you apply for employment opportunities with Kinetic, we may also collect

information about your qualifications, driver’s licence and accreditation and work experience.

The personal information you provide, or we otherwise collect in relation to an employment opportunity is collected, used, and disclosed to assess your application and conduct screening checks (including demerit points, health, reference, identity, eligibility to work and criminal records check). We may exchange your personal information with recruiters, screening check providers, law enforcement agencies, referees, and your former employers. Without your personal information, we will not be able to process your application. It is our policy not to retain your resume and other personal information related to your application after a position has been filled unless:

  • You are the successful candidate; in which case your resume will be held on your employee file or
  • Kinetic considers that another relevant position may become available, in which case your information will be held on our files until all such positions cease to be potentially available. We would of course contact you concerning any such roles.

If you are not the successful candidate and you do not want your resume and other personal information retained by us in relation to potential roles in the future, please contact us and we will securely destroy or permanently de-identify the information related to your application.

Access and correction of personal information

You are entitled to request access to and correction of any personal information that we hold about you. Please contact us as set out below to make such a request. If we deny any access or correction request, we will provide our lawful reasons. If we decide not to make a requested correction to your personal information and you disagree, you may ask us to make a note of your requested correction with the relevant information.

Security of information

We implement a range of measures to protect the personal information we hold about you from misuse, interference, and loss and from unauthorised access, modification, or disclosure. We will limit access to information within Kinetic where needed to protect sensitive personal information. If the personal information is no longer needed for any purpose, we take reasonable steps to destroy or permanently de-identify the personal information.

If you have a privacy complaint, please contact us so that we can promptly review and attempt to resolve the issue. We may request additional details from you regarding your concerns and may need to engage or consult with other parties in order to investigate and deal with your issue. We will keep records of your request and any resolution.
